By confirming a charter or using our Service, you adhere to these Terms. If you do not agree with any section of these terms, then you should refrain from using the Service.

2. Service Overview

CommonsLantern offers high-end yacht charter services that include, but are not limited to:

  • Day-long yacht hiring
  • Evening cruises
  • Business retreats
  • Exclusive events
  • Extended charters

All offerings are contingent on availability and climatic circumstances. We retain the right to alter or cease services at any given time.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

  • Be of at least 18 years old
  • Submit accurate and full details
  • Remit the required advance payment as stated in your reservation confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only after we have received the payment and provided our written acknowledgment. We maintain the right to decline service to any individual at our sole discretion.

3.3 Availability

All yacht charters are subject to the availability of the vessel and favorable weather conditions. We will endeavor to accommodate your requested dates and times to the best of our ability.

4. Payment Terms

4.1 Pricing

All fees are stated in € and comprise relevant taxes unless declared otherwise. Prices are susceptible to changes without prior notice.

4.2 Payment Schedule

  • Advance: 50% of the total charter cost is required at the time of booking
  • Remainder: Must be paid 48 hours before the charter's scheduled departure
  • Additional expenses (if any): Due at the charter's end

4.3 Payment Methods

We accept most major credit cards, electronic transfers, and certified cheques. We handle payment processing via secure, encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full reimbursement minus processing fees
  • 24-72 hours before departure: 50% reimbursement
  • Less than 24 hours before departure: No reimbursement

5.2 Weather Cancellations

If weather conditions are unsafe as determined by our captain, we will propose to:

  • Reschedule your charter to a subsequent available slot without extra charges
  • Process a full refund if an alternative date cannot be arranged

5.3 Mechanical Problems

In case your designated vessel encounters mechanical issues, we will strive to offer a comparable alternative. If an alternative is unavailable, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

Every passenger should:

  • Abide by all commands from the crew
  • Use safety gear as instructed
  • Inform us of any health conditions that may impact their safety
  • Remain within assigned sections of the yacht

6.2 Prohibited Items

The following items are barred from the yacht:

  • Glassware
  • Illegal substances
  • Weapons or firearms
  • Excess refreshments beyond reasonable personal consumption
  • Animals (unless pre-approved)

6.3 Conduct

Passengers are expected to behave respectfully. A charter may be terminated prematurely without a refund if a passenger's conduct endangers safety or disrupts the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

Our liability is capped at the cost paid for the charter. We are not responsible for:

  • Injuries sustained due to passenger carelessness
  • Personal belongings that are lost or damaged
  • Indirect or punitive damages, or losses not directly associated with our services
  • Delays due to weather or factors outside of our control

7.2 Insurance Coverage

We carry extensive marine insurance for our vessels and operational procedures. It is the passenger's own responsibility to obtain travel and personal insurance coverage.

7.3 Assumption of Risk

By participating in our charter services, you recognize that maritime activities come with inherent hazards and you accept responsibility for your own safety and well-being.

8. Modifications and Itinerary Changes

We hold the right to amend itineraries, routes, or timetables in light of weather conditions, safety imperatives, or operational needs. We will strive to offer alternative experiences of comparable value.

9. Force Majeure

We shall not be held accountable for delays, cancellations, or alterations caused by events beyond our control, including but not restricted to:

  • Extensive weather disturbances
  • Natural catastrophes
  • Regulatory directives
  • Closure of ports
  • Technical breakdowns

10. Privacy and Data Protection

Your personal data is managed in line with our Privacy Policy. By utilizing our services, you acquiesce to the accumulation and application of your data as outlined in our Privacy Policy.

11. Intellectual Property

The proprietary content on our website, including text, images, brand marks, and artwork, is secured by copyright and trademark legislations. Unauthorized replication, dissemination, or derivative work-making is strictly prohibited without our express consent.

12. Governing Law
